Asbestos fibers are deadly and can cause severe medical conditions, such as mesothelioma. A New York asbestos lawyer is skilled in handling asbestos lawsuits that seek financial compensation for the victims and their families for exposure to this harmful substance. These cases can be a bit complicated and it’s crucial to have a mesothelioma attorney to assist you.
New York has a long history of asbestos litigation and many residents have been exposed to this dangerous material. In recent years, there have been more lawsuits against former asbestos manufacturers than ever before. These cases are a result of the recognition of a connection between asbestos and diseases such as mesothelioma and lung cancer and asbestosis. These companies were aware of the dangers associated with this hazardous mineral, but didn’t warn their employees and clients.
The New York City area is particularly susceptible to asbestos-related ailments due to its old structures and numerous construction sites. The Brooklyn Navy Yard was a notoriously toxic location that continues to impact on the surrounding community.
Mesothelioma can be caused by exposure to asbestos in direct contact, and many workers were exposed to it at work. Exposure to asbestos from the outside can lead to mesothelioma. This is especially true for spouses who wear husband’s clothes to work and come into contact with asbestos dust regularly.
The mesothelioma lawsuit can be costly for defendants. This is especially relevant if they’ve been incorrectly identified as defendants. According to a study, more than 3,600 claims have been filed in New York courts since 2014 and the number could increase further. Specialized asbestos law firms often advertise on daytime TV and encourage victims to submit claims under the premise that they will receive significant settlements.
The defendants may be able reduce some of the costs of these cases by arguing that their policy periods are overdue or that they are only responsible for only a small percentage of the amount claimed. However, New York law has not provided a definitive rule regarding how to allocate liabilities when the alleged exposure is outside of the policy period of the insurer.
Asbestos-related illnesses
A myriad of asbestos-related illnesses can be triggered due to exposure to the toxic mineral. The most serious of these is mesothelioma. Many have died from mesothelioma. Other asbestos-related diseases include lung cancer asbestosis, pleural plaques, and the pleural effusion.
Mesothelioma is a rare but fatal condition that is caused by asbestos fibers which are found in the lungs. They then irritate the linings of the ribcage (the pleura), chest cavity and abdominal cavity. Inhaling these tiny fibers can result in scarring of the lungs known as asbestosis and occasionally, the formation of thickened patches on the pleura referred to as pleural plaques or the more widespread fibrosis of the pleura called diffused pleural the fibrosis. Pleural plaques and diffused fibrosis decrease lung capacity as measured by breathing tests. They can also cause pain and difficulties in breathing, however they do not lead cancer or mesothelioma.
Often, symptoms of asbestos-related diseases do not appear until decades after the initial exposure. This is because it can take between 20 and 50 years for the inhalation of asbestos fibers to cause lung damage. Workers who handled, cleaned and removed asbestos from the workplace and their spouses, children, and others exposed to asbestos are at risk for developing mesothelioma.
In addition to mesothelioma other asbestos-related illnesses include laryngeal cancer, lung cancer, peritoneal mesothelioma, and ovarian mesothelioma. The most dangerous form of mesothelioma is called ovarian cancer, but it’s much less common than the general mesothelioma. It is often diagnosed later than other types of mesothelioma since it develops in the tissues of the reproductive organs and the symptoms can be similar to symptoms of other illnesses.
There were many companies that used asbestos in the 20th century, but they were aware that it was hazardous. They exposed thousands of people to asbestos because they failed to remove it from their products. Now, these people have the right to sue for financial compensation. Many asbestos-related companies have gone bankrupt. In the aftermath, victims can seek the compensation they deserve from the trust funds established by the bankruptcy courts.
